1. Introduction
Welcome to ACE – Aeromia Coffee Emporium ("ACE", "we", "our", or "us"). We operate this website and online store to provide premium aviation-inspired apparel, accessories, artwork and lifestyle products. Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services. By accessing or using our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.
2. Eligibility and Accounts
You confirm that you are legally capable of entering into a binding agreement or have permission from a parent or guardian. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Information you provide must be accurate and current.
3. Products
Many ACE products are manufactured on demand after an order is placed through our trusted fulfilment partners. Product colours, print placement and sizing may vary slightly due to screen settings and the manufacturing process and are not considered defects. We reserve the right to discontinue products or limit quantities at any time.
4. Orders
Submitting an order constitutes an offer to purchase. Orders are accepted only after payment has been successfully processed and ACE confirms acceptance. Because many products are custom-made, changes or cancellations cannot normally be made once production has started.
5. Pricing and Payment
Prices may change without notice. Taxes, shipping, customs duties and import fees may apply depending on your location. You agree to provide accurate billing information and authorize payment using a valid payment method.
6. Production, Shipping and Delivery
Production times and delivery estimates are provided for guidance only and are not guaranteed. ACE is not responsible for delays caused by shipping carriers, customs, weather or events beyond our reasonable control. Ownership and risk of loss pass to you once your order has been handed to the shipping carrier, except where prohibited by applicable law.
7. Returns and Refunds
Returns, exchanges and refunds are governed exclusively by our published Return & Refund Policy. By placing an order, you acknowledge that you have read and accepted that policy.
8. Intellectual Property
All ACE trademarks, logos, aircraft artwork, illustrations, product designs, photographs, graphics, videos, website content, marketing material and branding are the exclusive property of Aeromia Coffee Emporium or are used under licence. No content may be copied, reproduced, modified, distributed or used without our prior written permission.
9. Limited Edition Collections
Certain ACE collections are produced in limited quantities. Availability is not guaranteed and ACE reserves the right to discontinue or retire designs without prior notice.
10. Aviation Heritage
References to historic aircraft and aviation heritage are used for artistic, educational and historical inspiration. Unless expressly stated, ACE is not affiliated with or endorsed by any aircraft manufacturer, military organisation or trademark owner.
11. Third-Party Services
Our website may include services or links provided by third parties. Shopify powers our online store. Purchases are made directly with ACE. Shopify is not responsible for the products you purchase from ACE. Third-party services are used at your own risk.
12. Feedback
Any reviews, comments or suggestions you submit may be used by ACE to operate, improve and promote our business. You retain ownership of your original intellectual property, while granting ACE a non-exclusive, worldwide, royalty-free licence to use such feedback for these purposes.
13. Acceptable Use
You agree not to misuse the website, upload malicious software, infringe intellectual property rights, scrape data using automated tools, impersonate others or engage in unlawful conduct. We may suspend or terminate access for violations.
14. Disclaimer
The Services and products are provided on an 'as is' and 'as available' basis to the fullest extent permitted by law. Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer protection laws.
15. Limitation of Liability
To the fullest extent permitted by law, ACE, its employees, affiliates, fulfilment partners and service providers shall not be liable for indirect, incidental or consequential damages arising from use of the Services or products.

You agree to indemnify and hold harmless ACE, Shopify and our service providers from claims arising from your breach of these Terms or unlawful use of the Services.

These Terms are governed by the laws of the Republic of South Africa, without limiting any mandatory consumer rights that may apply in your jurisdiction.
